1. Overview

Mapkin is an AI-powered map application that provides personalized, subjective recommendations to help you discover and explore places. The App is designed for personal, non-commercial use.

Please read these Terms of Service (“Terms”) carefully before using the Mapkin mobile application (“App”) operated by Nalin Bhardwaj (“we”, “our”, or “us”).

By downloading or using Mapkin, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have your parent or guardian's permission to use the App.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Mapkin for personal use only, subject to these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App;
• Reverse engineer or attempt to extract the source code;
• Use the App for any illegal or unauthorized purpose;
• Use the App to infringe on the rights of others.

4. Location Services

Mapkin requires access to your device's location to provide personalized recommendations and map services. By using the App, you agree to:

• Grant location permissions when prompted (you can revoke this at any time through device settings);
• Allow us to process your location data as described in our Privacy Policy;
• Understand that disabling location services will limit app functionality.

5. User Conduct and Queries

When using Mapkin's search and AI features, you agree to:

• Use the App respectfully and in accordance with applicable laws;
• Not submit queries that are abusive, harassing, or violate the rights of others;
• Not attempt to exploit or abuse the AI recommendation system;
• Not use the App to engage in any commercial activity without our written permission.

6. AI-Generated Recommendations

By using Mapkin's AI recommendation features, you acknowledge that:

• Recommendations are generated using artificial intelligence and may not always be accurate or appropriate;
• We do not guarantee the quality, safety, or suitability of any place recommended by the App;
• You are responsible for verifying information about places before visiting them;
• Business information (hours, prices, availability) may be outdated;
• The App's opinions and recommendations are subjective and for entertainment purposes.

7. Third-Party Services

Mapkin integrates with third-party services including:

• Map providers (e.g., Google Maps, Mapbox) for map display and place information;
• AI services for generating recommendations and processing queries;
• Place data providers for business information and reviews.

These services are subject to their own terms and conditions. We are not responsible for any issues arising from third-party services.

8. Subscriptions and Payments

Mapkin offers auto-renewable subscription plans (weekly, monthly, and annual) that provide access to premium features. Current pricing is displayed in the App at the time of purchase. By purchasing a subscription, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Subscription prices are displayed in the App and may vary by region. Prices are subject to change, but we will notify you in advance of any price increases.

9. Modifications to the App

We may update or modify the App from time to time, including adding or removing features, changing pricing, or discontinuing the App entirely. We are not liable for any loss or inconvenience caused by such changes.

10. Termination

We may suspend or terminate your access to the App at any time and for any reason, including violation of these Terms.

You may stop using the App at any time. To request deletion of your account and data, please contact us at nalin@mapkin.io.

11. Disclaimers

The App is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be uninterrupted, secure, or error-free;
• Recommendations will be accurate, appropriate, or up-to-date;
• Map data or place information will be correct;
• The App will meet your specific requirements.

You use the App at your own risk and are solely responsible for any decisions you make based on App recommendations.

12. Limitation of Liability

To the fullest extent permitted by law, Nalin Bhardwaj shall not be liable for:

• Any indirect, incidental, special, or consequential damages;
• Loss of data, profits, or business opportunities;
• Personal injury or property damage resulting from your use of the App or visiting places recommended by the App;
• Issues arising from the use of third-party services, AI-generated content, or map data;
• Inaccurate, outdated, or misleading information about places.

In no event shall our total liability to you for all claims arising out of or relating to the use of or inability to use the App exceed one hundred US dollars ($100). Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

13. Indemnity

You agree to indemnify and hold harmless Nalin Bhardwaj and its affiliates from any claims, liabilities, damages, and expenses arising out of:

• Your use of the App;
• Your violation of these Terms;
• Your violation of any rights of another person or entity.

14. Intellectual Property

All intellectual property in the App, including trademarks, logos, and software, is owned by Nalin Bhardwaj or its licensors. You may not use this material without our written consent.

Map data and place information are provided by third parties and subject to their respective copyrights and terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

16. Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You and Nalin Bhardwaj agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert individual claims in small claims court if your claims qualify.

Before initiating arbitration, you agree to first contact us at nalin@mapkin.io to attempt to resolve the dispute informally. If the dispute is not resolved within 60 days after the informal notice is sent, either party may commence arbitration.

Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be conducted in San Francisco, California, unless you and we agree otherwise. Each party will be responsible for paying their own filing, administrative, and arbitrator fees.

Class Action Waiver: You and we each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and we each waive any right to a jury trial.

17. Feedback

If you provide us with any feedback, suggestions, or ideas regarding the App (“Feedback”), you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license to use, copy, modify, create derivative works based upon, and otherwise exploit the Feedback for any purpose without compensation or attribution to you.

18. Survival

Upon any termination, discontinuation, or cancellation of your access to the App, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable by an arbitrator or court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

20. Entire Agreement and Assignment

These Terms constitute the entire and exclusive understanding and agreement between you and Nalin Bhardwaj regarding your use of the App, and supersede all prior oral or written agreements or understandings.

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.

22. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or update the “Effective Date” above. Continued use of the App constitutes acceptance of the updated Terms.

23. Apple Licensed Application End User License Agreement

Mapkin is licensed to you, not sold. Your use of the App is also subject to the terms and conditions of Apple's Licensed Application End User License Agreement (“Standard EULA”), which is incorporated herein by reference. In the event of any conflict between these Terms and the Standard EULA, these Terms shall govern to the extent permitted by applicable law.
